The National Innovation Visa Subclass 858, commonly called the NIV 858, is an invitation-only permanent residence visa for individuals with an internationally recognised record of exceptional and outstanding achievement.

What Is the National Innovation Visa?

The National Innovation Visa is a permanent visa for established and emerging leaders with exceptional talent and skills who can make a significant contribution to Australia’s future prosperity.

It replaced the former Global Talent Visa pathway for new applicants and operates through a federal Expression of Interest and invitation process.

Unlike Australia’s General Skilled Migration visas, the NIV:

  1. Is not based on a points test
  2. Does not require an occupation-list score
  3. Does not generally require employer sponsorship
  4. Does not use a competitive age-points system
  5. Does not require a fixed investment amount
  6. Does not provide an automatic invitation after EOI submission
  7. Requires evidence of exceptional and outstanding achievement
  8. Requires an eligible Australian nominator
  9. Requires an invitation before a visa application can be lodged

Candidates may be inside or outside Australia, subject to the applicable visa-status requirements

Benefits of the NIV Subclass 858 Visa

Between April and June 2026, the Department:

  2. Issued 248 invitations
  3. Issued most invitations to candidates in Tier One priority sectors

The leading invited sectors during that period included:

Candidates nominated through an approved Form 1000 by an Australian Commonwealth, state or territory government agency fall within the federal Priority Two category. However, an invitation remains discretionary and is not a pre-assessment of visa eligibility.

 

Reality Check:

Submitting an EOI does not place an applicant in a guaranteed visa queue. The NIV is a small, highly competitive and evidence-driven program.

Who Can Qualify for the NIV 858?

An applicant must generally demonstrate:

  • An internationally recognised record of exceptional and outstanding achievement
  • Current prominence in their area of achievement
  • The ability to be an asset to the Australian community
  • The ability to obtain employment or become independently established in Australia
  • Nomination by an eligible Australian person or organisation
  • Functional English where applicable
  • Compliance with health and character requirements
  • Receipt of an invitation before lodging the visa application

Is There an NIV Age Limit?

There is no general maximum age preventing a candidate from being considered.

However, applicants who are:

  • Under 18 years old; or
  • 55 years old or older

must demonstrate that they would be of exceptional benefit to the Australian community.

South Australia NIV Nomination Categories

South Australia considers internationally recognised candidates under five broad categories.

 

Global Researchers and Thought Leaders

This category may be relevant to:

  1. Senior researchers
  2. University academics
  3. Scientists
  4. Technical experts
  5. Policy specialists
  6. Research commercialisation leaders
  7. Recognised industry thought leaders

Strong indicators may include:

  1. National or international research grants
  2. Keynote appearances at major international conferences

  6. Research from a highly ranked global university
  7. A senior South Australian appointment

A PhD alone is not enough. South Australia considers the applicant’s influence, recognition, research quality, leadership and prospective contribution to the state.

 

Entrepreneurs

Entrepreneurs should demonstrate that their proposed activities will result in:

  1. Commercialisation of an innovative product or service in South Australia; or
  2. Development of an enterprise that will add significant value to the South Australian economy.

The applicant should also show:

  1. Relevant industry knowledge and expertise
  2. A successful entrepreneurial track record
  3. A credible commercialisation strategy
  4. Commitment to launching the venture in South Australia
  5. Potential for sustainable growth
  6. Potential to create jobs for South Australians
  7. Evidence that most business development, assets and staff will be based in South Australia

There is no prescribed minimum investment threshold for South Australian nomination under the entrepreneur category. However, the absence of a fixed threshold does not remove the requirement to demonstrate credibility, innovation, funding capacity and economic benefit.

 

Innovative Investors

This category is intended for investors with an established record of:

  1. Supporting successful innovative ventures
  2. Building or scaling high-growth companies
  3. Leading internationally recognised companies
  4. Supporting companies through significant commercial growth or an IPO
  5. Providing strategic capital to innovative ecosystems

South Australia does not prescribe a fixed minimum investment amount for this category.

However, ordinary passive or lifestyle investments are not automatically considered innovative.

Activities generally not regarded as innovative for this nomination category include:

  1. Cafés and restaurants
  2. Consulting companies
  3. Employment or labour-hire agencies
  4. Franchises
  5. Purchasing an existing business
  6. Real estate or rental management
  7. Retail businesses

Managed-fund investment is considered only in exceptional circumstances and should demonstrate significant past and future economic benefits to South Australia.

 

Creative Talent

Creative professionals should demonstrate significant international achievement in their field.

Evidence may include:

  1. International awards
  2. Major exhibitions
  3. Critically recognised creative work
  4. International performances
  5. Commercial success
  6. Major commissions
  7. Global media recognition
  8. Leadership in a creative discipline
  9. Demonstrated contribution to South Australia’s creative economy

Other Globally Talented Individuals

Individuals who do not fit within the main categories may be considered case by case.

This may include certain:

The applicant must still demonstrate substantial international achievements and a credible future contribution to South Australia.

Application Process

South Australia NIV Application Process

Step 1: Complete a Detailed Profile Assessment

Your qualifications, international recognition, achievements, industry standing, proposed South Australian contribution and supporting evidence should be critically reviewed.

Step 2: Select the Correct Nomination Category

Your case should be positioned under the most appropriate category:

Step 3: Prepare the South Australia Registration of Interest

The NIV Registration of Interest is submitted through South Australia’s Skilled and Business Migration portal.

  5. Salary evidence
  6. South Australian job offer, where applicable

Step 4: Attend a South Australian Assessment Interview

If the ROI progresses, the applicant may be interviewed by an assessment panel of South Australian Government representatives.

The panel may assess:

  2. International recognition
  3. Proposed South Australian activities
  4. Commercial or research viability
  5. Employment prospects
  6. Commitment to South Australia
  7. Expected economic or community benefit

Step 5: Receive Form 1000 and Business Case Support

If South Australia approves the nomination, it will provide:

  1. A completed Form 1000
  2. A business case letter

These documents can then be used in the applicant’s federal NIV Expression of Interest.

Step 6: Submit the Federal NIV Expression of Interest

The federal EOI explains the applicant’s achievements, proposed Australian contribution and nomination.

The EOI:

  1. Is free to submit
  2. Is not a visa application
  3. Does not provide a bridging visa
  4. Remains in the system for two years
  5. Cannot normally be updated or supplemented after submission
  6. Does not guarantee an invitation

Applicants should not submit multiple EOIs unless there has been a significant change in circumstances.

Step 7: Receive an Invitation

If selected, the applicant receives an invitation code and unique reference identifier. The applicant has 60 days from the invitation date to submit the complete visa application. The period cannot be extended.

Step 8: Lodge the Subclass 858 Visa Application

The applicant must provide evidence supporting:

  1. Exceptional and outstanding achievement
  2. Current prominence
  3. Australian benefit
  4. Ability to establish themselves in Australia
  5. The achievement forming the basis of the invitation
  6. Nominator eligibility
  7. Health and character compliance
  8. Family-member eligibility

An invitation is not an approval. The Department independently assesses the complete application.

Form 1000 and the Australian Nominator

A valid NIV application requires a completed Form 1000—Nomination for National Innovation Visa.

The nominator must be:

  1. An Australian citizen
  2. An Australian permanent resident
  3. An eligible New Zealand citizen; or
  4. An Australian organisation

The individual or organisation should have an appropriate national reputation in the applicant’s area of achievement.

The nominator attests that the applicant:

  1. Has an internationally recognised record of exceptional and outstanding achievement
  2. Remains prominent in the field
  3. Would be an asset to Australia
  4. Can obtain employment or become independently established in Australia

The official Form 1000 states that the nominator must not receive a fee for completing the form. In South Australia’s case, form 1000 is signed by South Australia Government.

Warning:

A person offering to “sell” a guaranteed Form 1000 or government nomination should be treated with extreme caution.

Eligible members of the family unit may generally be included in the application, including:

The National Innovation Visa is being promoted in the market by some so-called consultants as an easy or guaranteed route to Australian permanent residence.

Applicants should be cautious of “soft-scam” style marketing that may not involve an obvious fake document but uses misleading promises, incomplete information or artificial urgency to secure payment.

Warning Signs

Be careful if anyone claims:

  • “Every PhD holder qualifies”
  • “Your NIV invitation is guaranteed”
  • “We have guaranteed South Australia slots”
  • “We can sell you a Form 1000”
  • “You must pay the Australian nominator”
  • “Any business investment qualifies”
  • “Buying a café or existing business guarantees nomination”
  • “State nomination means the visa is approved”
  • “Our government contacts will secure your invitation”
  • “No international evidence is required”
  • “A high salary automatically guarantees NIV”
  • “You must pay immediately before the quota closes”

These claims do not accurately reflect the official process.

South Australia’s nomination application is free, a Form 1000 nominator must not be paid for completing the form, and neither state nomination nor federal invitation guarantees a visa grant.

Common Reasons NIV Cases Fail

The Profile Is Strong Only Locally

Senior employment or recognition within one company or city may not demonstrate international recognition.

 

The Applicant Relies Only on Qualifications

A doctorate, master’s degree or professional licence does not automatically establish exceptional and outstanding achievement.

 

Achievements Are Not Independently Verified

Claims should be supported by credible evidence from institutions, government bodies, industry organisations, journals, media, clients or independent experts.

 

The South Australian Benefit Is Unclear

The applicant must explain what they will do in South Australia and how the state will benefit.

 

The Business Proposal Is Generic

Opening an ordinary consultancy, retail outlet, restaurant, franchise or real-estate business is not automatically innovative.

 

The Nominator Is Unsuitable

The nominator must meet the legal requirements and should be able to credibly attest to the applicant’s achievements.

 

The EOI Is Submitted Too Early

A federal EOI cannot normally be updated after submission. Filing a weak or incomplete EOI can waste the two-year consideration period.

 

State Nomination Is Treated as Visa Approval

South Australian support may improve federal priority, but Home Affairs separately decides whether to issue an invitation and whether to grant the visa.
