European Residence Through Qualifying Investment

The Portugal Golden Visa, officially known as the Residence Permit for Investment Activity—ARI, allows eligible non-EU nationals to obtain Portuguese residence through an approved investment.

The programme may suit investors who want:

  1. Portuguese residence with a low physical-stay requirement
  2. Schengen travel
  3. Family inclusion
  4. The right to live and work in Portugal
  5. Access to a future permanent-residence or citizenship strategy
  6. Investment exposure without relocating to Portugal full-time

Portugal’s Golden Visa remains open, but new real-estate purchases and ordinary capital transfers no longer qualify. Current investments must follow one of the legally approved routes and cannot be directed, directly or indirectly, toward real estate.

Current Portugal Golden Visa Investment Options

€500,000 Investment Fund Route

The investment must be placed in units of a qualifying non-real-estate Portuguese collective investment undertaking.

The fund must generally:

  1. Be established under Portuguese law
  2. Have a maturity of at least five years when the investment is made
  3. Invest at least 60% of its capital in companies headquartered in Portugal
  4. Avoid direct or indirect real-estate investment

€500,000 Company and Job-Creation Route

The applicant may invest at least €500,000 in:

  1. Establishing a Portuguese company and creating five permanent jobs; or
  2. Increasing the capital of an existing Portuguese company while creating at least five permanent jobs; or
  3. Maintaining at least ten jobs, including a minimum of five permanent positions.

The qualifying employment conditions must generally be maintained for at least three years.

Important: Buying a house, apartment, hotel unit or other Portuguese real estate does not qualify a new Golden Visa applicant

  5. Renew the residence permit while maintaining the qualifying investment

  7. Pursue Portuguese nationality after meeting the current legal requirements

The initial ARI residence permit is currently valid for two years and may be renewed for further two-year periods while the investment and other conditions remain satisfied.

Minimum Stay Requirement

 

The Portugal Golden Visa is attractive to internationally mobile investors because it does not require full-time residence.

The minimum stay is generally:

  1. Seven days during the first year
  2. Fourteen days during each subsequent two-year period

The days may be consecutive or accumulated over separate visits.

General Eligibility Requirements

Applicants must generally:

  1. Be nationals of a country outside the EU, EEA, Andorra and Switzerland
  2. Complete an approved investment
  3. Maintain the investment for the required period
  4. Demonstrate lawful source of funds
  5. Transfer the investment capital through compliant banking channels
  6. Hold a valid passport and lawful Schengen entry status
  7. Meet criminal-record and security requirements
  8. Complete biometrics in Portugal
  9. Pay the applicable AIMA charges

The qualifying investment must normally be maintained in Portugal for at least five years.

Can Your Family Be Included?

Eligible family members may generally include:

  1. A spouse
  2. Minor or dependent children
  3. Unmarried dependent adult children who are studying
  4. Dependent parents of the applicant or spouse
  5. Minor siblings under legal guardianship in qualifying circumstances

Portugal’s current family-reunification rules contain specific provisions for family members of ARI residence-permit holders.

Application Process

Step 1: Select the Investment Route

Compare the legal structure, risk, liquidity, expected holding period and costs of each qualifying option.

Step 2: Complete Due Diligence

The investor should verify:

  1. Fund or business structure
  2. Regulatory status
  3. Investment terms
  4. Management charges
  5. Exit conditions
  6. Job-creation obligations
  7. Source-of-funds requirements
  8. Tax consequences

Step 3: Obtain Portuguese Documentation

This may include:

  1. Portuguese NIF
  2. Portuguese bank account
  3. Criminal-record documents
  4. Certified translations
  5. Powers of attorney
  6. Family civil-status documents

Step 4: Complete the Investment

The qualifying funds must be lawfully transferred and properly documented.

Step 5: Submit Through the ARI Portal

The investor and accompanying family submit the application and supporting documents through Portugal’s official ARI system. The portal also facilitates fee payment and scheduling with AIMA.

Step 6: Attend Biometrics

The principal applicant and qualifying family members attend the required AIMA appointment in Portugal.

Step 7: Receive and Renew Residence Cards

The residence permit must be renewed while the qualifying investment and other legal requirements remain satisfied.

Permanent Residence and Citizenship

Golden Visa residence may contribute toward eligibility for Portuguese permanent residence, subject to the applicable residence, language, criminal-record and other requirements.

Applicants should be cautious of websites and sales agents still advertising citizenship automatically after five years. Under the current Portuguese Justice Ministry guidance, ordinary nationality eligibility based on legal residence generally requires at least 10 years of legal residence, together with Portuguese-language and other statutory requirements. Citizenship is not automatic and the rules may change again
